Policy Overview
This document outlines the intellectual property rights regarding the services operated by Ardcast Services Limited ("the Company"), a subsidiary of Ardcast Limited ("the IP Owner"). This policy complies with the Copyright, Designs and Patents Act 1988 (UK), the Digital Millennium Copyright Act (US), and applicable international IP conventions.
1. Company Intellectual Property Rights
1.1. Ownership Structure
You acknowledge and agree that Ardcast Limited is the sole and exclusive owner of all legal right, title, and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist).
Ardcast Services Limited operates the Services under an exclusive license from the IP Owner. All references to "Company IP" or "Our IP" in this document refer to the proprietary property of Ardcast Limited.
1.2. Protected Assets
This protection includes, but is not limited to:
Source Code & Logic: All backend code, mortgage calculation algorithms, financial modeling formulas, and frontend scripts (HTML/CSS/JS).
Visual Identity: The "look and feel" of the website and Apps, colour schemes, layout designs, button styles, and graphics.
Databases: All aggregated data, user databases, and product catalogues structure.
Content: All text, blog posts, help documentation, and editorial content created by the Company.
1.3. No Transfer of Rights
Nothing in the Terms gives you a right to use any of the Group’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features, except as expressly permitted in Section 4.
2. Prohibited Uses (Scraping & AI)
As a technology-focused group, we strictly protect our data from unauthorized automated extraction.
2.1. Data Mining and Scraping
You are strictly prohibited from using any automated systems, including "robots," "spiders," "offline readers," or "scrapers," to access the Services for the purpose of copying, harvesting, or extracting data. This includes scraping mortgage rates, product prices, or user profiles.
2.2. Artificial Intelligence Training
The use of any Content from our Services to train Artificial Intelligence (AI) or Machine Learning (ML) models is expressly prohibited without a specific commercial license agreement. We reserve the right to block any IP address or user agent associated with such activity.
3. User-Generated Content & Moral Rights
3.1. License Grant
By retaining copyright in the content you submit (reviews, forum posts, profile data), you grant the Company (and its parent, Ardcast Limited) a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, and distribute any Content which you submit, post, or display on or through the Services.
3.2. Waiver of Moral Rights (UK Specific)
To the fullest extent permitted by law, you hereby waive your "moral rights" (as defined in the Copyright, Designs and Patents Act 1988) in any Content you submit. This means the Company may use your content without identifying you as the author and may modify the content (e.g., editing a review for length) without your prior approval.
4. Brand Usage Guidelines
We permit the limited use of our Brand Assets solely for the purposes of referring to our Company.
4.1. Permitted Use
You may use our Name in text to refer to our services factually (e.g., "Check mortgage rates on Ardcast Services Limited").
You may link to our homepage or blog posts.
4.2. Prohibited Use
You may not use our logo in a way that implies partnership, sponsorship, or endorsement by the Company without written consent.
You may not register domain names or social media handles that are confusingly similar to our Brand (e.g., "Ardcast Services LimitedSupport" or "Ardcast Services LimitedOffers").
You may not alter, distort, or modify our logo.
5. Copyright Infringement (DMCA & CDPA)
We respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from our Services infringe your copyright, you may request removal of those materials by submitting a written notification to our Copyright Agent.
5.1. Filing a Notice
Your notice must include:
Physical or electronic signature of the copyright owner or authorized agent.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing (URL or Screenshot).
Contact information (Address, Phone, Email).
A statement that you have a "good faith belief" that use of the material is not authorized by the copyright owner.
A statement that the information is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

6. Counter-Notice Procedure
If you believe your material was removed in error, or if you have the necessary rights to post the material, you may send a counter-notice. We will forward your counter-notice to the original complainant.
If the original complainant does not file a court action against you within 10-14 business days, we may restore the removed content. By submitting a counter-notice, you consent to the jurisdiction of the Federal District Court (if in the US) or the Courts of Scotland (if in the UK/RoW) regarding legal disputes arising from the takedown.
7. Repeat Infringer Policy
In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, the Company has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be "repeat infringers."
We may also at our sole discretion limit access to the Services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
8. Third-Party Content & APIs
8.1. External Tools
Our Services may integrate with third-party APIs (e.g., Google Maps, Financial Data Providers). The intellectual property rights for data provided by these services remain with their respective owners. We make no claim of ownership over live market data streams or map data.
8.2. User Links
We are not responsible for the content of websites linked to by our users. The inclusion of any link does not imply endorsement by the Company. We disclaim all liability for any IP infringement occurring on third-party sites.
