Service Availability Policy

This policy outlines the expectations regarding the uptime, maintenance, and availability of the digital services provided by Ardcast Services Limited.
1. Uptime Goals (No Guarantee)
We strive to make our Services available 24 hours a day, 7 days a week. However, we utilize shared cloud infrastructure and complex software systems where 100% uptime is not technically feasible.
1.1. Target vs. Guarantee
While we aim for an uptime of 99.9% ("Three Nines"), this is an internal target and not a legally binding guarantee. Unless you have a specific written Service Level Agreement (SLA) with us:
We do not offer credits or refunds for downtime.
We accept no liability for business losses, lost profits, or data loss caused by service interruptions.
2. Scheduled Maintenance
To ensure the security and performance of our platform, we must perform periodic maintenance (e.g., database upgrades, security patching).
We reserve the right to take our services offline for maintenance:
Routine Maintenance: We attempt to schedule updates during off-peak hours.
Emergency Maintenance: Critical security patches may be applied immediately and without prior notice.
Access to our services may be suspended temporarily and without notice in the case of system failure, maintenance, or repair.
3. Exclusions (Force Majeure)
We are not responsible for unavailability caused by factors outside our reasonable control, including but not limited to:
Acts of God, natural disasters, war, or civil disturbance.
Failures of our upstream providers (e.g., Amazon Web Services, Cloudflare, Internet Service Providers).
Denial of Service (DDoS) attacks or other malicious cyber activities.
Government action or court orders.
4. Data Backup & Loss
While we implement robust backup procedures for our own disaster recovery purposes:
Your Responsibility: You are solely responsible for maintaining independent backups of any data you upload or generate using our tools.
No Liability: We shall not be liable for any loss of data caused by service interruptions, software bugs, or user error.
5. Enterprise SLAs
For enterprise customers requiring guaranteed uptime commitments and financial remedies for downtime, we offer customized Service Level Agreements (SLAs).
These agreements are separate from this general policy. If you require an SLA, please contact our Sales team to discuss an Enterprise contract.
